Own the car
On the final payment the vehicle becomes yours and we refund your security deposit balance within 14 days.
Your obligations under the agreement
These are the terms every hirer signs. Read them carefully.
Keep it insured
The vehicle must carry comprehensive insurance in the joint names of the owner and you, for as long as the hiring continues. You pay the premiums.
Pay all duties
Licence duties, registration, road-worthy fees, taxes and other charges on the vehicle are yours to pay.
Keep it in good repair
Maintain the vehicle and allow the owner (or anyone authorised) access to inspect its condition.
Do not part with it
You may not sell, pledge, mortgage, sub-let, lend or hand over the vehicle, or let it be run for another person.
Cover damage
Make good all damage (fair wear and tear excepted). In a total loss you pay the full value. After an accident, the purchase value is reviewed with 2% additional interest once the vehicle is fixed or replaced.
Pay on time
A missed week without an approved reason attracts a GHS 100.00 default penalty, deducted automatically from your security deposit.
Two consecutive missed weeks
If you fail to pay for two weeks in a row without a justifiable reason approved by us, the owner reserves the sole right to repossess the vehicle and terminate the contract. We will always contact you first — talk to us early if you are struggling.
If we repossess the vehicle the hiring ends at that point, and we may then sell it without needing your approval, at the best price reasonably obtainable. The sale money, less the cost of recovering and selling the vehicle, is credited to your account: anything left over is paid to you within 14 days with a written account, and if it does not cover what you owe we may recover the difference from you and from your guarantor, in court if necessary. Your deposit is not forfeited — what you owe in arrears, penalties and recovery costs is set off against it and the balance refunded.
Our obligations under the agreement
The agreement binds PK Auto Dealership too. These are the commitments we make to you, for as long as the hiring lasts and when it ends.
You get the car you inspected
Before you sign you inspect the vehicle yourself, and its make, year, registration, chassis and colour go into the agreement. The car we hand you is that car, in the condition you accepted, with the road documents we hold for it.
We leave you to drive
For as long as you keep to the agreement the vehicle stays in your hands to use and earn from, and we only ask to inspect its condition at reasonable times. We will not seize it or hold it except in the one case the agreement allows — two consecutive missed weeks — and then only after written notice and 14 days for you to settle. If we ever end the hiring early for any other reason, you get one month's written notice first.
We record every payment
Every payment you report is recorded against your contract and checked against the money received. Once we confirm it you get an SMS and a receipt you can download, and your week-by-week schedule always shows what is paid and what is left.
Your deposit stays yours
Your security deposit is a surety, not part of the purchase price. We take nothing from it except what the agreement allows, and we tell you the amount, the reason and the balance each time. When the agreement ends we refund the balance within 14 days, with a written statement. If we have repossessed, we may hold back only the arrears, penalties and recovery costs then owing — never the rest of the purchase price — and anything still held comes back within 60 days at the latest.
We talk to you first
If a week is missed, that week's rent and the penalty come out of your deposit at once and we tell you straight away — the amount, the penalty and what is left. Bring us a genuine reason and we will consider it. Before we ever repossess, you get written notice and 14 days to settle.
We hand over ownership
On your final payment the hiring ends and the vehicle becomes your property. We assign every right we hold in it to you, pass across the benefit of any insurance then running, release the vehicle documents and complete the DVLA transfer with you. The DVLA's own fees stay yours, as they are throughout the hiring, and we charge nothing extra for settling early.
Frequently asked questions
Yes. The deposit is a surety, not part of the purchase price. It is held for the life of the contract and refunded to you when you finish paying. If a week is missed, we deduct that week (plus the penalty) from the deposit — you can top it back up.
The week is marked missed, a GHS 100.00 penalty is applied, and the amount is automatically deducted from your security deposit so your schedule stays on track. You and the office both get an SMS. Two consecutive misses without an approved reason can lead to repossession.
Yes. You may buy the vehicle outright at any time during the hiring by paying the outstanding balance in one lump sum. There is no early-settlement penalty.
Once the full purchase price and any other sums due are paid, the hiring ends, ownership transfers to you and we assign all our rights in the vehicle to you.
You do — comprehensive cover in the joint names of the owner and yourself, for as long as the hiring continues. If the vehicle is not insured, we charge the prevailing comprehensive rate from your deposit at completion.
Yes, with one month's written notice. If the hiring is terminated you return the vehicle at your expense; that does not cancel any arrears or claims already owing.
Mark the payment in your account as soon as you send it. Once we confirm the money in the designated account, we approve it — you get an SMS and a downloadable receipt, and every timestamp is recorded.
The hiring ends when the vehicle is repossessed. Within 14 days we send you a written account of everything you paid, the arrears, the penalties and your deposit. We may then sell the vehicle without your approval, at the best price reasonably obtainable. The net sale price is credited against what you owe; any surplus is paid to you within 14 days with a written account, and any shortfall remains a debt we may recover from you or your guarantor.
